Learned State Counsel says that it is apparent from the copy of the plaint annexed as Annexure No. 1 to the present petition that original plaintiff Ram Dheeraj and original defendant no.1/Shiv Rani, expired during the pendency of the suit, but in the instant petition Ram Dheeraj has impleaded as opposite party no.1 and legal heirs of original defendant no.1/Shiv Rani have not been impleaded. Taking note of the aforesaid, learned counsel for the petitioners submits that she may be permitted to withdraw the present petition with liberty to file a fresh petition with proper parties, pleadings and documents in support thereof. To the aforesaid prayer, learned Standing Counsel has no objection. Accordingly, the present petition is dismissed with liberty as aforesaid. Office is directed to return back all the certified copies of order and documents, annexed in the present petition, to the learned Counsel for the petitioner, if he applies for the and submit the copies of same.
