The contention of learned counsel for the petitioner is that despite the enhancement in gratuity having been made by the order dated 24.10.2019 yet the arrears of gratuity have been paid belatedly. 15.05.2023 passed in Writ A No. 3540 of 2023 in re: Yogesh Chand Pandey & others vs State of U.P. and others that the Court had directed for payment of interest @7% per annum on the amount of delay in payment of gratuity and prays that the benefit of the said order be also extended to the petitioner. To the aforesaid prayer Ms Sruti Sahu, learned counsel who appears on behalf of Respondents no. 2 & 3 has no objection. Accordingly, considering that despite the gratuity having been enhanced vide the order dated 24.10.2019 yet the same has been paid belatedly, as such the writ petition is disposed of with a direction to the respondents to pay interest @7% per annum following the judgement of this Court in the case of Yogesh Chand Pandey (supra) with effect from 24.10.2019 till date of actual payment.
