¶1Heard learned counsel for petitioners and learned Standing Counsel for the State.

¶2Petitioners have approached this Court against a notice dated

21.6.2023 whereby they have been asked to vacate the shop.

¶3Learned counsel for petitioners submits that no opportunity of hearing was given before issuing the said notice. The said notice dated 21.6.2023 contains a reason on which eviction of petitioners is sought.

¶4In the given circumstances, petitioners are permitted to submit their reply before respondent no.5-Block Development Officer/Secretary, Kshetra Panchayat Dalmau, District Raebareli within a period of ten days from today along with a certified copy of this order. The respondent no.5 thereafter shall consider the reply of the petitioner and pass a reasoned and speaking order in accordance with law.

¶5Any action against the petitioners shall be subject to final orders passed by respondent no.5. In case petitioners fail to submit their reply within the aforesaid period of ten days, benefit of this order would not be available them.
