¶1Heard learned counsel for the petitioners, learned Standing Counsel for State-respondents and Shri Vikram Dutt Pandey, Advocate holding brief of Shri Pankaj Gupta, learned counsel for respondent no.5.

¶2By means of the present petition, the petitioners have assailed the order dated 23.06.2023 whereby the opposite party no.4/Sub Divisional Officer, Tehsil Kaiserganj, District - Bahraich modified the order of interim protection provided to the petitioners on 20.06.2023 in the case instituted under Section 116 of U.P. Revenue Code, 2006 (in short "Code, 2006") pending as Case No. 4186/2013 (Computerized Case No. T202308150304186, Ashok Kumar Tiwari & Others Vs. Hare Krishna & Others) as also the dated 13.07.2023 passed in the revision preferred by the petitioners registered as Case No. 997/2023 (Computerized Case No. C202308000000997, Ashok Kumar Tiwari & Others Vs. Hare Krishna & Others).

¶3Considered the submission made by the learned counsel for the petitioners and nature of the suit/case as also the period prescribed under Rule 109(10) of the U.P. Revenue Code Rules, 2016, as per which, the suit for division of holdings should be decided preferably within a period of six months as also the observations made in the order dated 13.07.2023 passed by Revisional Authority according to which the parties are having full opportunity to place their case before opposite party no. 4, the relevant portion of the same is extracted herein-under. "

¶4Upon due consideration of aforesaid, this Court is not inclined to entertain this petition at this stage of proceedings and accordingly, it is disposed of in following terms:

(i) It is open for the petitioners to place their case before the revenue court concerned namely opposite party no.4/Sub Divisional Officer, Tehsil Kaiserganj, District - Bahraich.

(ii) The opposite party no. 4 is directed to decide the suit within a period of six months from the next date fixed, if possible and if there is no other legal impediment.
