¶1Heard Sri Ajeet Kumar, learned counsel for the applicant, Sri Rishikesh Verma, the learned AGA for the State and perused the records.
¶2The instant application has been filed seeking release of the applicant on bail in Case Crime No.25 of 2023, under Sections 420, 406 IPC, Police Station Kotwali Nagar, District Barabanki.
¶3The aforesaid case has been registered on the basis of an FIR. lodged on 06.01.2023 against three persons, not including the applicant, stating that the informant had made investments in the company for purchasing a plot but neither the plot was transferred to him nor was his money refunded.
¶4The applicant's involvement in 42 other cases of similar nature has been disclosed in para 15 of the affidavit filed in support of the applicant and the applicant has been granted bail in 13 cases.
¶5The learned A.G.A. has opposed the prayer for bail but he could not dispute the aforesaid aspects of the matter.
¶6Having considered the aforesaid facts and circumstances of the case and keeping in view the fact that the informant claims to have entered into an agreement to purchase land from a company but it appears that no registered agreement was executed for purchasing immovable property; that the applicant is described as a Director of the company, and the applicant is a lady of 66 years of age, I am of the view that the aforesaid facts are sufficient for making out a case for enlargement of the applicant on bail in the aforesaid case.
¶7Accordingly, this bail application stands allowed.
¶8Let the applicant-Mithlesh Verma be released on bail in the aforesaid case on furnishing a personal bond and two sureties each in the like amount to the satisfaction of magistrate/court concerned, subject to following conditions:
(i) the applicant shall not tamper with the prosecution evidence;
