Court No. - 16 Case :- CRIMINAL MISC. BAIL APPLICATION No. - 13325 of 2023 Applicant :- Atul Kumar Verma Opposite Party :- State Of U.P. Thru. Prin. Secy. Home Lko. Counsel for Applicant :- Ajeet Kumar Counsel for Opposite Party :- G.A. Hon'ble Subhash Vidyarthi,J.
¶1Heard Sri Ajeet Kumar, learned counsel for the applicant, the learned AGA-I for the State and perused the records.
¶2The instant application has been filed seeking release of the applicant on bail in Case Crime No. 673 of 2022, under Sections 420, 409 IPC, Police Station Kotwali Nagar, District Barabanki.
¶3The aforesaid case has been registered on the basis of an FIR. lodged on 04.10.2022 against three persons, including the applicant, describing him as a director in STS group, stating that the informant had made investments in the company for purchasing a plot but neither the plot was transferred to him nor was his money refunded.
¶4The applicant's involvement in 54 other cases of similar nature has been disclosed in para 19 of the affidavit filed in support of the applicant and the applicant has been granted bail in 22 cases.
¶5The learned A.G.A. has opposed the prayer for bail but he could not dispute the aforesaid aspects of the matter.
¶6Having considered the aforesaid facts and circumstances of the case and keeping in view the fact that the informant claims to have entered into an agreement to purchase land from a company but it appears that no registered agreement was executed for purchasing immovable property; that although the applicant is described as a Director of the company, he claims that he is not a director and he has been implicated merely for the reason that he is son of the director of the company, I am of the view that the aforesaid facts are sufficient for making out a case for enlargement of the applicant on bail in the aforesaid case.
¶7Accordingly, this bail application stands allowed.
¶8Let the applicant-Atul Kumar Verma be released on bail in the aforesaid case on furnishing a personal bond and two sureties each in the like amount to the satisfaction of magistrate/court concerned, subject to following conditions:
(i) the applicant shall not tamper with the prosecution evidence;
(ii) the applicant shall not pressurize the prosecution witnesses;
(ii) the applicant shall appear on each and every date fixed by the trial court. (Subhash Vidyarthi, J.) Order Date :- 8.11.2023 prateek High Court of Judicature at Allahabad, Lucknow Bench
