Judgment

Court No. - 6 Case :- MATTERS UNDER ARTICLE 227 No. - 5789 of 2023 Petitioner :- Kamlesh Respondent :- Learned District Judge District Sultanpur And 3 Others Counsel for Petitioner :- Prateek Tewari,Sujeet Kumar Yadav Hon'ble Rajnish Kumar,J. Shri Prateek Tewari, learned counsel for the petitioner at the outset submits that inadvertently and due to typographical mistake, Lucknow has been mentioned in place of Sultanpur in prayer "a" of the petition and he may be permitted to correct the same. In view of above, learned counsel for the petitioner is permitted to delete Lucknow from the first line of prayer "a" and mention Sultanpur as it has been stated that the Panchayat Revision is pending before the District Judge, Sultanpur, during course of the day. Heard learned counsel for the petitioner. Submission of learned counsel for the petitioner is that the petitioner has filed a Panchayat Revision against the dismissal of Election Petition No.5059 of 2021 and the term of the elected Pradhan has remained about one and a half year, therefore there is urgency in the matter, however the Panchayat Revision is not being disposed of for one or the other reason. From perusal of the order sheet it appears that the notices have still not been served on all the opposite parties, therefore the gadget notification has been directed to be made and the case was listed on 08.11.2023. Therefore, it would not be appropriate to issue any direction at this stage. In view of the order proposed to be passed in this petition, the requirement of issuance of notice to the opposite parties is dispensed with. This petition is disposed of, without entering into the merit of the case, with liberty to the petitioner to move application for expeditious disposal before the concerned court for disposal of Panchayat Revision No.8 of 2023. In case any such application is moved within a period of ten days from today, the same shall be considered by the concerned court and appropriate order shall be passed thereon within a further period of ten days and proceed accordingly as per law and decide the revision in a time bound manner, it there is no impediment. ...................................................................(Rajnish Kumar, J.)
