In view of order proposed to be passed, issuance of notice to the private-respondents is hereby dispensed with. By means of this petition, the petitioner seeks expeditious disposal of Appeal No.1809 of 2023 pending before the respondent No.2. Seeking prayer to expedite the proceedings of pending appeal, it is stated that as per Para 458(2) of U.P. Revenue Court Manual, the appeal or revision, as the case may be, should be decided within a period of six months and as such, indulgence of this Court is required. Learned State counsel submits that he has no objection in case an expedite order is passed. Considering the aforesaid, this petition is disposed of with a direction to the respondent No.2-Board of Revenue, U.P., Lucknow to consider and decide the Appeal No.1809 of 2023 after taking note of para 458(2) of U.P. Revenue Court Manual expeditiously. While considering the appeal proper opportunity of hearing shall be provided to the parties to the litigation. To conclude the proceedings unnecessary adjournment shall be avoided. It is made clear that the Court has not examined the case of either party on merits and the Authority concerned shall be free to decide the matter strictly in accordance with law.
