Petitioners have approached this Court claiming that the Executive OfÏcer, Nagar Palika Parishad and State respondents are forcibly trying to demolish house of the petitioners. Admittedly, petitioners have filed O.S. No. 288 of 2019 for declaration against the State Government as well as the Executive OfÏcer, Nagar Palika Parishad and Chairman, Land Management Committee including the Sub-Divisional Magistrate concerned. In the given circumstances, it is open for the petitioner to file his injunction application also in the said suit itself, where rights of the parties are to be decided. In case such an injunction application is filed, the court concerned shall consider and decide the same in accordance with law, as expeditiously as possible. Writ petition is disposed of accordingly.
