¶2The instant application has been filed seeking release of the applicant on bail in Case Crime No. 1066 of 2022, under Sections 420, 409 IPC, Police Station Kotwali Nagar, District Barabanki.
¶3The aforesaid case has been registered on the basis of an FIR. lodged on 04.10.2022 against three persons, including the applicant, describing him as a director in STS group, stating that the informant had made investments in the company for purchasing a plot but neither the plot was transferred to him nor was his money refunded.
¶4The applicant's involvement in 59 other cases of similar nature has been disclosed in para 15 of the affidavit filed in support of the applicant and the applicant has been granted bail in 12 cases.
¶5The learned counsel for the applicant has submitted that co-accused Atul Kumar Verma, has already been granted bail by means of an order dated 22.09.2023 passed by this Court in Criminal Misc. Bail Application No. 11411 of 2023.
¶6The learned A.G.A. has opposed the prayer for bail but he could not dispute the aforesaid aspects of the matter.
¶7Having considered the aforesaid facts and circumstances of the case and keeping in view the fact that the informant claims to have entered into an agreement to purchase land from a company but it appears that no registered agreement was executed for purchasing immovable property; that he has been implicated merely for the reason that he is director of the company and that a co-accused a has already been granted bail, I am of the view that the aforesaid facts are sufficient for making out a case for enlargement of the applicant on bail in the aforesaid case.
¶8Accordingly, this bail application stands allowed.
