¶1Heard learned Counsel for the petitioner, learned Standing Counsel for the State, Sri Paramanand Asthana, learned counsel for respondent no.3, and Sri Dileep Singh, who has filed his Power today on behalf of respondent no.4, which is taken on record.

¶2In our considered opinion and in view of the submissions raised by learned counsel for respondents, the petitioner has a remedy of filing an appeal against the impugned order of reservation under Section (4) of Section 15 of the U.P. Sugarcane (Regulation of Supply and Purchase) Act, 1953 read with the 1954 Rules thereunder.

¶3In view of the aforesaid statutory remedy available to the petitioner, we leave to the petitioner to file an appeal within a week from today. In case the same is filed within a week from today, the same shall be decided within two weeks thereafter and if the petitioner moves for an interim relief, the same shall be considered in accordance with law.
