¶1Heard learned counsel for petitioner and learned State Counsel for opposite parties.

¶2Petition has been filed seeking a direction to opposite parties for payment of regular salary along with arrears with effect from March 2022 with interest.

¶3It has been submitted that petitioner was engaged as Helper (in nomenclature of Sahyogi) in the cooperative Department vide order dated 08.06.1989. It is submitted that despite fact that no departmental or any other enquiry is pending against petitioner, salary ever since March, 2022 has not been paid to petitioner although no orders pertaining to his termination from service has been passed.

¶4For the said grievance, petitioner has already submitted a representation but seeks liberty to file a fresh representation before the authority concerned. At present, learned counsel for petitioner restricts prayer with regard to final decision on the same.

¶5Considering the innocuous prayer, without entering into merits, liberty is granted to petitioner to file a fresh representation before opposite party no.2 i.e. Commissioner-cum-Registrar, Co-operative, U.P., Lucknow who shall consider and decide the same in light of relevant rules within a period of six weeks from the date a certified copy of this order is produced before the said authority along with fresh representation.
