¶1Heard learned Counsel for the petitioner, learned Standing Counsel for the State and Shri Pankaj Gupta, learned Counsel for respondent no.5.

¶2The present petition filed in public interest has raised a grievance against cutting down of green trees in order to implement the Jal Jeevan Mission Scheme.

¶3It is averred in the writ petition that the implementation of the scheme in question for construction of a water tank some green trees are being cut.

¶4Shri Pankaj Gupta, learned Counsel for the Gaon Sabha, has stated that there is no other land feasible for the construction of water tank, therefore, the public utility land identify for the purpose is being utilized.

¶5It is submitted that ample care shall be taken not to cut down the trees and in case any number of trees is cut for implementation of the scheme, it shall be obligatory upon the construction agency/local authority to plant double the number of trees cut or damaged on the boundary side of the water tank.
