This petition has been filed for a direction for disposal of Regular suit no.105 of 2023 (Kajal Mishra vs Vinod Kumar Mishra) filed under Section 13 of the Hindu Marriage Act, 1955 on the ground that the marriage was solemnized by concealment of fact. Perusal of the order sheet indicates that notices were issued on

01.08.2023 and the date was fixed on 17.10.2023. Thereafter, on an application moved by the petitioner, he has been permitted to serve through Senior Jail Superintendent, Lucknow by means of the order dated 03.08.2023. He further submits that notice has been served and the case is listed on 12.12.2023. In view of the above, admittedly the respondent has not put in appearance and he is in jail. The written statement has also yet not been filed. The case is of the year, 2023. In view of the above, no direction can be issued for disposal of the suit, at this stage. The petition is dismissed.
