Sri Amit Kumar Singh learned counsel for the petitioner submits that the petitioner has filed Regular Suit no.29 of 2020 (J.M. Infraheights Pvt. Ltd vs Baseer Ahmad) for specific performance along with an application under Order 39 Rule 1 and 2 C.P.C for interim injunction, on which, the notices were issued. However, the application for interim injunction has not been disposed of till date and prays for a direction for disposal of the application within some short stipulated period. In view of above, without entering into the merits of the case, the petition is disposed of with liberty to the petitioner to move an appropriate application for expeditious disposal of his application for interim injunction under Order 39 Rule 1 and 2 C.P.C before the concerned court. In case, any such application is moved by the petitioner within a period of two weeks from today, the concerned court shall consider the same and pass appropriate order thereon within a period of two weeks thereafter and proceed accordingly in accordance with law, to decide the aforesaid pending application.
