Judgment

Court No. - 20 Case :- WRIT - A No. - 8929 of 2023 Petitioner :- Mahendra Pratap Singh Respondent :- State Of U.P. Thru. Chief Secy. Lalbahadur Sastri Bhawan U.P. Secy. Lko And 3 Others Counsel for Petitioner :- Manish Misra,Dileep Pandey Counsel for Respondent :- C.S.C. Hon'ble Manish Mathur,J. Heard learned counsel for petitioner and learned State Counsel appearing on behalf of opposite parties. Petition has been filed challenging order dated 20th October, 2023 whereby petitioner has been transferred to district Deoria. Earlier petitioner had filed writ A No. 7567 of 2023 challenging order dated 29th September, 2023 whereby he was transferred from district Sitapur to Lucknow on the post of Regional Forest Officer. Since it had been claimed that petitioner has barely eleven months to superannuate and is covered by paragraph 5 of the government order dated 7th June, 2023, the said petition was disposed of vide order dated 9th October, 2023 directing the concerned authority to decide petitioner's representation in the light of government order dated 7th June, 2023. It is relevant that impugned order has been passed in pursuance of directions issued by this court. It is also evident that earlier transfer of petitioner vide order dated 29th September, 2023 has been rescinded and now petitioner has been posted in district Deoria primarily on the ground that it is adjacent to his home district Gorakhpur. Learned counsel for petitioner submits that petitioner has also joined in pursuance of the impugned order. Considering aforesaid facts, it is evident that substantive compliance has been made by opposite parties of the directions issued by this court earlier. Petitioner has also joined in pursuance of the impugned order. This court therefore does not find any occasion to interfere with the order impugned. Petition is therefore dismissed.
