The petitioner has approached this Court claiming that for Recovery Certificate dated 21.08.2023 issued against him by the Adjudicating Officer, U.P. Real Estate Regulatory Authority, Old Hyderabad, Lucknow-Respondent No.4. However, it appears that the Adjudicating Officer is already forwarded the same for recovery to the District Magistrate. In the given circumstances, the petitioner has an alternative remedy to approach the District Magistrate to show that the entire amount is already deposited by the petitioner as well as to move an appropriate application to Adjudicating Officer itself to recall of his order, if the petitioner is already deposited. In case such an application annexing with the record that the petitioner has already deposited the entire amount is moved before the Adjudicating Officer / District Magistrate, they may decide the same in accordance with law.
