¶1Heard Sri Bhupendra Kumar Bajpai, learned counsel for the petitioners, learned Standing counsel on behalf of respondent No.s 1 and 2 and Sri Pankaj Gupta on behalf of respondent No.s 5 and 6 while notice on behalf of respondent No.s 3 and 4 has been accepted by Sri Kumar Ayush.

¶2It has been submitted on behalf of the petitioners that they are working on the post of Rasoiyan ( Cook) in Purva Madhyamik Vidyalaya, Bahorikpur, Block Mahsi, District Bahraich and have performed the duty of the said post for 14 years and continued till May, 2023 after which they have not been permitted to work. It is in aforesaid circumstances that the petitioners gave representation to the District Magistrate, who has further directed the Block Education Officer to decide the same and at presently the matter is pending before District Basic Education Officer i.e. opposite party No.3 to decide the representation of the petitioner dated 19.8.2023 as contained in Annexure No.7 to the writ petition, expeditiously.

¶3Learned counsel for opposite parties do not object to the prayer made by the petitioners.

¶4In view of the above, without entering into merits of the case, the petition is disposed of with a direction to opposite party No.3 to consider and decide the representation of the petitioners dated 9.10.2023 and 22.8.2023.

¶5Liberty is also granted to the petitioner to move a fresh representation to the District Basic Education Officer, Bahraich within two weeks from today. In case such a representation is made the authority concerned is directed to consider and decide the same in accordance with law, expeditiously, say within a period of six weeks from the date a certified copy of this order along with the representation is placed before him.
