Heard counsel for the parties and gone through the record. Submission of counsel for the petitioner is that by the impugned ofÏce memorandum dated 23.09.2023, petitioner has been debarred from taking part in tenders of UPPTCL for a period of two years with immediate effect. Further submission is that the said memorandum is issued without any notice or opportunity of hearing to the petitioner. Ms. Eshita Bhasin, learned counsel for UPPTCL fairly accepts that the said ofÏce memorandum is issued without giving any notice or opportunity of hearing to the petitioner. In view thereof, the impugned ofÏce memorandum dated

23.09.2023 cannot stand and is hereby set aside with liberty to the respondents, in case they so desire, to pass appropriate orders, after giving notice or opportunity of hearing to the petitioner.
