The present writ petition has been filed with a prayer to issue a writ, order or direction in the nature of certiorari for quashing the first information report dated 30.01.2023 at Case Crime No.0021 of 2023 under Sections 419, 420, 467, 468, 471, 504, 323 IPC at Police Station Baundi, District Bahraich and with a further prayer to stay the arrest of the petitioner. Learned AGA has produced instructions dated 28.08.2023 sent by Sub Inspector Shri Ram Aashish Yadav, police station Baundi, District Bahraich and the same is taken on record. In the said instructions it has been stated that charge sheet no. 176 of 2023 has been filed against co-accused Rajendra Gupta alias Baba son of Rammanorath and Budhilal son of Avadhram on

26.07.2023 before the Court concerned. Further it has been stated that accused Naangu son of Shri Mungul and Ramnaresh son of Shri Harinath, i.e. the petitioner herein, were not co-operating in the investigation. The Investigating Officer has approached the trial Court which has issued non-bailable warrants against them on 18.08.2023.
