¶1Heard learned counsel for petitioner and learned State Counsel for opposite parties.

¶2Petition has been filed seeking a direction to opposite parties for calculation of service rendered by him on daily wage basis with effect from 26.06.1982 for purposes of qualifying service for grant of retiral benefits.

¶3It has been submitted that initially petitioner was engaged as a part-time tube-well operator with effect from 26.06.1982 and was subsequently regularized in service on 29.10.2009 and subsequently superannuated on 30.06.2021 but is not being paid retiral benefits on the pretext that he has not completed the required qualifying service.

¶4For the said grievance, petitioner has already submitted a representation but seeks liberty to file a fresh representation before the authority concerned. At present, learned counsel for petitioner restricts prayer with regard to final decision on the same.

¶5Considering the innocuous prayer, without entering into merits, liberty is granted to petitioner to file a fresh representation before opposite party no.2 i.e. Chief Engineer, Irrigation and Water Resources Department Cantt. Road, Lucknow who shall consider and decide the same within a period of eight weeks from the date a certified copy of this order is produced before the said authority along with fresh representation.
