¶1Heard learned counsel for the petitioner and learned Standing Counsel for the State.

¶2Petitioner has approached this Court claiming that the private respondents are doing illegal construction over his property and the police is also supporting the respondents.

¶3On telephonic instructions, learned Standing Counsel states that police authorities are only trying to make law and order and have already initiated proceedings under Section 107/116 of Cr.P.C.

¶4It goes without saying that in a private dispute, petitioner is required to file a suit before appropriate Court for injunction and this Court under Article 226 of the Constitution of India cannot interfere in a private dispute.

¶5In view thereof, petition is consigned to record with liberty to the petitioner to approach appropriate Court. In case any injunction application is filed, the same shall be decided by the Court concerned expeditiously. .
