Judgment
Court No. - 10 Case :- CRIMINAL MISC. WRIT PETITION No. - 9479 of 2022 Petitioner :- Adarsh Pandey @ Brahmchari Respondent :- State Of U.P. Thru. Prin. Secy. Home And Others Counsel for Petitioner :- Om Prakash Nag,Amjad Siddiqui Counsel for Respondent :- G.A. Hon'ble Mrs. Sangeeta Chandra,J. Hon'ble Narendra Kumar Johari,J. Heard learned counsel for the petitioner and learned A.G.A. for the State. Learned A.G.A. has filed a short counter afÏdavit, wherein it has been stated that investigation has been concluded on 11.09.2023 and Charge Sheet No.124A/2023 dated 11.09.2023 has been sent to Circle OfÏcer against the petitioner Adarsh Pandey @ Brahmchari. Since the charge-sheet has been prepared by the Investigating OfÏcer, it is presumed that sufÏcient evidence has been collected and filed with the Charge-sheet before the Trial Court for its evaluation, therefore, this Court feels it to be inappropriate to interfere at this stage. The writ petition is dismissed with liberty to the petitioner to approach the Competent Court for raising his challenge to the Charge-sheet.
