Judgment

Court No. - 4 Case :- CONTEMPT APPLICATION (CIVIL) No. - 3217 of 2023 Applicant :- Pratap Narain Opposite Party :- Sri Sudhir Garg, Prin. Secy. Revenue Deptt. Lko. And Another Counsel for Applicant :- Dinesh Kumar Dixit,Vinay Mishra Hon'ble Rajesh Singh Chauhan,J.

¶1Heard learned counsel for the petitioner and Sri Amrendra Singh, learned Standing Counsel.

¶2Sri Amrendra Singh has stated that he has already filed the affidavit of compliance on 01.11.2023 therein the order dated

26.10.2023 passed by the District Magistrate, Bahraich has been enclosed, whereby the representation of the petitioner has been decided in terms of the order of Writ Court.

¶3The aforesaid affidavit is not traceable on record, therefore, the office is directed to trace out that affidavit and place the same on record.

¶4Learned counsel for the petitioner has stated that the District Magistrate, Bahraich has passed an illegal and unwarranted order dated 26.10.2023.

¶5Be that as it may, since the Writ Court has directed to decide the representation of the petitioner and has not entered into merits of the issue, therefore, considering the fact that the District Magistrate, Bahraich has passed the order dated

26.10.2023 deciding the representation of the petitioner, I do not find any good reason to keep this contempt petition pending any longer, inasmuch nothing remains to be adjudicated in the present contempt petition.

¶6Accordingly, the instant contempt petition is dismissed.

¶7Notices, if any, are discharged.

¶8However, it is always open for the petitioner to assail the order dated 26.10.2023 passed by District Magistrate, Bahraich, if the petitioner feels himself aggrieved from that order. [Rajesh Singh Chauhan,J.] Order Date :- 17.11.2023 kkv/ High Court of Judicature at Allahabad, Lucknow Bench
