This petition has been filed for removal of encroachment from Gata No.1595 recorded as 'Rasta' and Gata No.1601 recorded as 'Shamshan Bhumi' in the revenue record situated in Village Inayat Nagar, Tehsil Milkipur, District Ayodhya,in regard to which proceedings under Section 67 of the U.P. Revenue Code 2006 have already been instituted, which has been disclosed by the petitioner himself in paragraph 10 of this petition and Annexure No.6 has been annexed in this regard,therefore this petition is not maintainable. Even otherwise,as submitted by learned counsel for the petitioner, the petitioner is also using the said rasta therefore the personal interest of the petitioner is involved. Therefore also the P.I.L. is not maintainable. At this stage, learned counsel for the petitioner submits that the writ petition may be dismissed as not pressed. Dismissed accordingly as not pressed.
