¶3The present bail application has been filed by the applicant with a prayer to enlarge him on bail in NCB Crime No.20 of 2023, under Sections 8/21/29 NDPS Act, Police Station Narcotics Control Bureau, District Lucknow.

¶4It is contended by learned counsel for the applicant that 190 gms of morphine is alleged to have been recovered from the possession of the co-accused and it was to be delivered to the applicant. It is contended by learned counsel for the applicant that the co-accused Shyam Singh from whose possession the alleged substance was recovered, has been granted bail by coordinate Bench of this Court on 17.11.2023 in Criminal Misc. Bail Application No. 13419 of 2022. Thus, the case of the applicant is at better footing to that of co-accused. Learned counsel submitted that applicant has criminal history of one case which has been explained satisfactorily in para 4 of the supplementary afÏdavit. The applicant is in jail since

17.09.2023.

¶5Learned AGA opposed the prayer for bail but could not dispute the fact that the alleged contraband substance is below commercial quantity and the case of the applicant is on better footing than co-accused who has been granted bail.

¶6Without expressing any opinion on the merits of the case, after hearing learned counsel for the parties and considering the argument that the alleged contraband substance is below commercial ; argument that the case of the applicant stands on better footing than that of co-accused therefore, I am of the opinion that the applicant is entitled to be released on bail on the ground of parity.
