By means of present application under Section 482 Cr.P.C. the applicant, who is a senior citizen aged about 72 years, has assailed the order dated 03.11.2022 passed by the Sessions Judge, Ambedkar Nagar in Criminal Revision No.190 of 2022 (Shanichara & Others vs. Ram Prasad & Others). By the impugned order dated 03.11.2022, the revisional Court interfered in the order dated 24.09.2022 passed in the proceedings under Section 133 of Cr.P.C., registered as Case No.03798 of 2020, Computerized Case No.T202004040403798 and remanded the matter back to the trial court to decide the matter afresh fixing 23.11.2022 a date for appearance of the parties concerned. 03.11.2022 as also the order dated 24.09.2022, on being confronted, learned counsel for the applicant, after arguing at some length says that justice would suffice if a direction is issued to trial court to conclude the proceedings, in issue, within time specified as the matter relates to the proceeding initiated under Section 133 of Cr.P.C. The aforesaid has not been disputed by the learned AGA. In view of aforesaid, without interfering the impugned order dated 03.11.2022, the application is disposed of with direction to trial court to conclude the proceedings, in issue, as early as possible say within a period of three months from the next date fixed in the case i.e. 23.11.2022 mentioned in the order of remand itself.
