Sri Anuj Kumar Mishra, learned counsel for the petitioner submits that the respondent no.2 has filed a suit for permanent injunction bearing Regular Suit No.551 of 2019(Sheela Devi versus Karmraj and others), which is pending in the Court of Civil Judge(J.D.), Room No.9, Faizabad, in which an interim injunction has been granted on 03.07.2019. The petitioner has filed written statement on 06.08.2022 but thereafter the suit is not proceeding. Therefore a direction may be issued for disposal of the suit within some short stipulated period. Perusal of the order sheet indicates that the objection and reply appears to have been filed on 06.08.2022 and since then the case is being listed for disposal of the application 6 Ga therefore at this stage, no direction can be issued for disposal of the suit. However, in case there is any urgency to the petitioner, he may move appropriate application before the concerned court showing urgency in the matter, which may be considered by the concerned court. Even otherwise, the ground of urgency, if any, for disposal of the suit can be made before the concerned court only, who can consider the same. With the aforesaid, the petition is dismissed.
