¶1Heard learned counsel for the petitioners, Shri Vikram Pandey, Advocate holding brief of Shri Pankaj Gupta, learned counsel for respondent no.5 and learned Standing Counsel for the State respondents.

¶2Petitioner has approached this Court for mandamus commanding the opposite parties not to construct any module shop or permanent construction on the land Gata No.3473 measuring area 0.0980 Hectare situated at Village-Bangaon, Pargana Tehsil and District Colonelganj, Gonda.

¶3Petition is disposed of with liberty to the petitioner to file an application for demarcation of his land before the Sub-Divisional Magistrate, Tehsil Colonelganj, District-Gonda within a period of two weeks from today. In case petitioner files such an application under Section 24 of the U.P. Land Revenue Code, 2006 before the respondent no.3, the respondent no.3 shall proceed and decide the same on the basis of proper survey report and shall take the matter to its logical conclusion in accordance with law by a reasoned and speaking order after hearing all the concerned parties, within a period of six weeks from the date a certified copy of this order along with the application for demarcation is placed before him.
