¶3The aforesaid case has been registered on the basis of an F.I.R. lodged on 14.08.2021, against the applicant, one Farooq and some unknown persons alleging that one Abdul Qadir Sayeed Barrister had migrated to Pakistan at the time of partition of the country and neither he nor his heirs returned to India. The applicant had got executed a fictitious sale deed dated 08.11.1984 with the intention of grabbing a part of his property and mutation was carried out in furtherance of the sale deed by means of the order dated 18.06.2019 passed by the Naib Tehsildar, Birwa.

In the tenth case the applicant has not been summoned till date.

¶6Having considered the aforesaid facts and circumstances of the case and keeping in view the fact that the sale deed in question was executed on 08.11.1984 whereas the FIR has been lodged on 14.08.2021 i.e. after about 38 years; that the mutation of the applicant' name was carried out on 18.06.2019; that as per the FIR averments, no proceedings for cancellation of sale deed have been initiated before any court and that the applicant is a 62 years old person and is languishing in jail since
