This petition has been filed challenging the resolution of the Gaon Sabha dated 04.07.2023 by means of which the respondent no.5/Saraswati Prerarna Swayam Sahayata Samooh was selected for the Fair Price Shop licence of Village Panchayat-Bhaisaha, Block-Huzoorpur, Tehsil-Payagpur, District-Bahraich. Leaned Additional Chief Standing Counsel on the basis of instructions submits that the claim of the respondent no.5 on the basis of aforesaid resolution dated 04.07.2023, contained in annexure no.1 to the writ petition, has been rejected on the ground that the resolution was not in accordance with law and without open meeting and the name of four Samooh has been sent for approval on 15.09.2023 as they have been created after

04.07.2020, therefore the submission is that the present petition has rendered infructuous because the resolution dated

04.07.2023 has been found not in accordance with law and fresh selection has to take place.
