Judgment

Court No. - 6 Case :- MATTERS UNDER ARTICLE 227 No. - 5911 of 2023 Petitioner :- Kumaresh Doobe Respondent :- Civil Judge (Junior Division), Haweli, Faizabad And Another Counsel for Petitioner :- Mohd Wajid Irfan,Al Saud Khan Hon'ble Rajnish Kumar,J. Heard Sri Al Saud Khan learned counsel for the petitioner. This petition has been filed for a direction for disposal of Original Suit no.26 of 2022 (Kumaresh Doobe vs Bhanu Pratap). Learned counsel for the petitioner submits that the respondents are not willing to file written statement even then the case is not being decided. Perusal of the order sheet indicates that the case has already been proceeded exparte by means of the order dated

23.08.2023, therefore, the question of filing of written statement by the defendant does not arrive, at this stage. However, the petitioner himself has not filed evidence, for which, the case was listed on 15.11.2023, which had been adjourned on account of strike of lawyers. Therefore since the petitioner himself is not assisting the court, this Court is not inclined to issue any direction for disposal of the case at this stage. However, it is always open for the petitioner to move to the concerned court for expeditious disposal, who may consider the same, if there is no impediment. With the aforesaid, the petition is dismissed. ......(Rajnish Kumar,J.) Order Date :- 21.11.2023 Harshita High Court of Judicature at Allahabad, Lucknow Bench
