Learned counsel for the petitioner submits that the petitioner has filed Regular Suit no.1287 of 2023 (Rambali vs State of U.P) along with an application under Order 39 Rule 1 C.P.C., but the application has not been disposed of till date whereas there is urgency in the matter. Perusal of the order sheet indicates that the notices were issued on 04.07.2023 on the application filed under Order 39 Rule 1 C.P.C. Thereafter, whenever the case has been fixed, none had appeared on behalf of the parties, therefore, the case has been adjourned. In view of the above, when the petitioner himself is not assisting the Court in disposal of the case, no direction can be issued, at this stage, for disposal of the application.
