Court No. - 20 Case :- WRIT - A No. - 9009 of 2023 Petitioner :- Smt. Jai Shri Devi Respondent :- State Of U.P. Thru. Addl. Chief Secy. Rural Development Deptt. Lko. And 2 Others Counsel for Petitioner :- Ved Prakash Yadav Counsel for Respondent :- C.S.C. Hon'ble Manish Mathur,J.
¶1Heard learned counsel for petitioner and Mr. Jogindra Nath Verma, learned State Counsel appearing on behalf of opposite parties.
¶2Petition has been filed challenging order dated 01.11.2023 whereby petitioner has been posted from District Sultanpur to District Sonbhadra.
¶3Learned State counsel however submits that a perusal of impugned order will make it evident that the impugned order has been passed as a measure of new posting after promotion of petitioner and is in fact not a transfer.
¶4Learned counsel for petitioner however submits that he does not dispute the aforesaid fact but states that due to her family situation, it could be expedient in case petitioner is posted near Sultanpur since her husband and in laws are also there.
¶5For the aforesaid grievance, petitioner has already submitted a representation but seeks liberty to file a fresh representation before competent authority. At present learned counsel for petitioner restricts his prayer for a final decision with regard to same.
¶6Considering innocuous prayer being made by learned counsel for petitioner and without entering into the merits of the case petitioner is granted liberty to file a fresh representation before opposite party No.2 i.e. The Commissioner, Rural Development Department, Lucknow. In case such a representation is filed, the same shall be considered and decided by a reasoned and speaking order within a period of six weeks from the date a certified copy of this order is produced before the said authority.
¶7With the aforesaid observation, petition stands disposed of. Order Date :- 21.11.2023 Subodh/- High Court of Judicature at Allahabad, Lucknow Bench
