Learned Standing Counsel appearing for power corporation on instruction states that by mistake without passing final assessment order after the provisional order, recovery certificate has been issued. The same stands withdrawn by the department. The said statement is taken on record. It is provided that petitioner may file his objection to the provisional assessment order, which was served upon him within a period of ten days from today. In case, any such objection is preferred by the petitioner, the respondent no. 3, Executive Engineer, Electricity Supply Division, Purva, Unnao shall consider and decide the same by passing reasoned and speaking order in accordance with law within a period of four weeks, thereafter. Any action against the petitioner shall be subject to final orders to be passed by respondent no. 3. In case, objection is not submitted by the petitioner within the stipulated period, the benefit of this order would not be available to him. Writ petition is cosigned to record.
