Judgment

Court No. - 6 Case :- MATTERS UNDER ARTICLE 227 No. - 5938 of 2023 Petitioner :- Pioneer Montessori School, Lucknow Thru. Manager Sri Brajendra Singh And Another Respondent :- Jagjeet Singh And Others Counsel for Petitioner :- Dharmendra Gupta Hon'ble Rajnish Kumar,J. Sri Dharmendra Gupta, learned counsel for the petitioner submits that the petitioner has filed Regular Suit No.608 of 2019(Pioneer Montessori School versus Jagjeet Singh & Others) for mandatory injunction, recovery of money and damages but the same has not been disposed of till date and no orders are being passed and only general dates are being fixed. Perusal of the order sheet indicates that the case has been adjourned on the last two dates on account of strike of lawyers. Prior to that, the petitioner himself was not present, therefore, the allegation of the petitioner against the court concerned that no orders are passed and only general dates are being fixed is totally misconceived and not tenable. Even otherwise, prior to that also the case has been adjourned on some dates on account of strike of lawyers or the Presiding Officer was attached with the High Court. On a query being put, learned counsel for the petitioner also failed to indicate any urgency in the matter. Therefore only on merely asking of the petitioner that the suit may be disposed of expeditiously, no direction can be issued by this Court for expeditious disposal of the case in a time bound manner, when there is huge pendency of cases. Dismissed accordingly. Order Date :- 22.11.2023 Akanksha High Court of Judicature at Allahabad, Lucknow Bench
