¶1Present petition has been filed with the following prayer: "I. Issue a writ, order or direction in the nature of Mandamus thereby commanding the opposite party no.3 to take appropriate decision upon the application of the petitioner dated 15/02/2023 including 30/08/2023 contained as Annexure No.2 and 3 which is in regard to removing of encroachment from Chak Marg, Gata No.1864 admeasuring area 0.0610 Hect. of Village - Banghusra, Post and Tahsil - Payagpur, Block - Vishesharganj, District - Bahraich in the interest of justice. ......"

¶2A counter affidavit has been filed by the State today in Court stating that the offending constructions have been removed. The said counter affidavit has been taken on record.

¶3In view of the fact that the affidavit has been filed by the Naib Tehsildar himself stating that the offending constructions have been removed, nothing survives further in the matter.
