Petitioner has approached this Court challenging an order dated

16.10.2023 passed by respondent no. 6-Block Development Officer, Block Jamo District Amethi whereby the respondent no. 6 has required to petitioner to deposit the amount referred in the impugned order and produce the receipt thereof. He further submits that it is on the basis of an ex-parte order and without giving any opportunity of hearing to the petitioner. Considering the aforesaid, the impugned order cannot stand and the impugned order dated 16.10.2023 is hereby set aside. Writ petition is allowed with liberty to the respondents, in case they so desire, to pass afresh order after giving due opportunity of hearing/notice, copy of ex-parte enquiry report, all other documents relied upon against the petitioner, to the petitioner.
