Heard learned counsel for the parties and perused the record. Petitioner has approached this Court claiming that there is demand notice dated 01.10.2023 for recovery of Rs.2.21.119/- and an OTS scheme has been initiated by the respondent department in which an application is to be filed by 30.11.2023. Shri Rakesh Kumar Yadav, holding brief of Shri Neera Yadav, learned counsel for the respondent-Corporation states that in case the petitioner applied for the said scheme within a period provided under the Scheme as per the provisions, the same shall be decided within a period of two months thereafter. In view of above, the Executive Engineer Madhyanchal Vidyut Vitran Nigam Limit Vidyut Vitran Khand-3, Colonelganj, District - Gonda, is directed to consider and decide the application of the petitioner for the said scheme by a reasoned and speaking order in accordance with law within a period of two from the date application of the petitioner is moved alongwith certified copy of this order. It is made clear that this court has not applied itself on the merits of the case and all questions are left open to be considered and decided by the competent authority in accordance with law.
