Heard learned counsel for the petitioners, learned A.G.A. for the State/Respondents, Shri Sankalp Mishra, holding brief of Shri Ratnesh Chandra for opposite party No.4. and perused the record. This petition has been filed with the prayer to issue a writ, order or direction in the nature of Certiorari quashing the impugned First Information Report No. 0004/2023 dated 03.01.2023 registered under Sections 406, 419, 420, 467, 468, 471, 504, 506 I.P.C., at Police Station Chinhat, District Lucknow. A further prayer has been made to issue a writ, order or direction in the nature of mandamus commanding the opposite parties not to initiate any further proceedings against the petitioner on the basis of impugned First Information Report. This Court has perused the report submitted by Mediation and Conciliation Center of this Court. Mediation between the parties has failed. Short counter affidavit has been filed by the Investigating Officer which is kept on record. This Court has gone through the impugned F.I.R. and finds a cognizable offence to be made out.
