¶1Heard Sri Rajat Rajan Singh, learned counsel for the petitioner, learned Standing Counsel appearing for respondents no.1, 6 and 7, Sri Umesh Singh, learned counsel for respondent no.2, and Sri Devak Vardhan Singh, learned counsel for respondents no.3 to 5.

¶2At the very outset, learned counsel for the petitioner states that against the order impugned dated 23.08.2023, the petitioner had preferred an appeal to respondent no.4 in which the Chairman vide his order dated 10.10.2023 has stayed the penalty. He further states that as the aforesaid appeal is pending as such the instant writ petition may be disposed of with a direction to respondent no.4 to decide the pending appeal in accordance with law after hearing all the parties concerned.

¶3To the aforesaid proposition, Sri Devak Vardhan, learned counsel for respondents no.3 to 5, has no objection.

¶4Keeping in view the aforesaid, the writ petition is disposed of with a direction to respondent no.4 to decide the pending appeal of the petitioner in accordance with law and relevant rules after hearing all the parties concerned provided there is no legal impediment.
