Petitioner has approached this Court for a mandamus commanding opposite parties to execute a sale deed of plot no. 4/528, Gomti Nagar Extension, Lucknow which was allotted to the petitioner through lottery system conducted on 28.02.2005 for which entire dues were paid by

12.11.2007. Counsel for the petitioner states that the amount paid was Rs. 7,66,747/- on 12.11.2007 and thereafter. A stand is taken on behalf of the respondent that the said plot could not be located on spot as there was certain land disputes going on. Counsel for the petitioner submits that grievance of the petitioner would be sufÏciently met in case the entire amount be returned with appropriate interest. Counsel for respondent-Development Authority states that the respondent authorities are ready and willing to return the amount along with the interest @ MCLR plus 1%. Let the entire amount of the petitioner be returned along with interest @ MCLR plus 1% within a period of two months. Writ petition is disposed of.
