In view of the fact that another Second Appeal bearing No.351 of 1980, which also involved identical facts related to the same plot and the issue was also the same has already been decided by the co-ordinate Bench of this Court by means of the judgement and decree dated 14th August, 2001. Being aggrieved by the State to get the order reviewed, was also attained finality as the review petition also came to be dismissed as abated. Thus, where the issue involved in the instant petition already stands concluded in the case of State of U.P. Vs. Balvir Kaur and others; Second Appeal No.351 of 1980. The instant appeal also deserves to the same fate and for the reasons recorded in the order dated 14th August, 2001, the appeal stands dismissed. The judgements passed by the two courts are affirmed.
