1.Heard Sri Alok Kumar Misra, learned counsel for the petitioners, learned Standing counsel for respondent No.s 1 to 5 and Sri Tushar Gupta holding brief of Sri Pankaj Gupta for respondent No.6-Gram Panchayat.

¶2In view of the order proposed to be passed notice to respondent No.7 is dispensed with.

¶3It has been submitted on behalf of the petitioners that for the purpose of appointment of fair price shop dealer for Gram Panchayat Bakhariha, Block Katra Bazar, District Gonda meeting was held on 2.11.2023 where resolution was passed in favour of respondent No.7. It is submitted that the petitioner who is a member of Self Help Group was also an application for grant of the said license but the Gram Sabha has illegally passed a resolution in favour of respondent No.7.

¶4The grievance raised in the present writ petition pertains only to aspect that the representation of the petitioner may be considered by the Tehsil Level Committee at the stage of scrutinizing the resolution passed by the Gram Sabha.

¶5Learned counsel for the respondents do not object to the prayer made by the petitioner.

¶6Accordingly, it is directed that in case the resolution dated 2.11.2023 has not already been scrutinized and approved / disapproved by the Tehsil Level Committee, they shall consider the representation of the petitioner at the stage of scrutinizing the proposal and forward the recommendation to the District Magistrate. In this regard liberty is given to the petitioner to file fresh representation before Sub Divisional Magistrate, Utraula, District Balrampur, who is the Chairman of the Tehsil Level Committee within next three days.
