The instant application under Section 483 Cr.P.C. has been preferred for the following main relief:- "Wherefore, it is most respectfully prayed that this Hon'ble Court be pleased to direct the Learned Court of Additional Chief Judicial Magistrate IInd, District-Lucknow to decide the complaint case bearing No. 1695 of 2023 (Nidhi Singh vs. Parmanand Singh & Others) filed by petitioner under Section 12 of Domestic Violence Act, 2005, Police Station-Indria Nagar, District-Lucknow, filed by petitioner against opposite party No.2 to 4, within stipulated time as provided by this Hon'ble Court in the interest of justice." Taking note of the facts and circumstances of the case as also that the Complaint in issue is pending consideration since April, 2023 before the Court concerned and also Section 12(5) of the Domestic Violence Act, 2005, which says that the Magistrate shall make all endeavour to dispose of the application made under Sub-Section (1) within a period of sixty days from the date of first hearing, present application is disposed of with a direction to the Court concerned to consider and decide the complaint in issue, expeditiously.
