Heard learned counsel for the petitioner, learned AGA who appears on behalf of State-respondents and perused the record. This writ petition has been filed with a prayer to issue a writ, order or direction in the nature of Certiorari for quashing of the impugned F.I.R. dated 7.3.2023 registered as F.I.R. No. 108/2023 under Section 3(1) U.P. Gangster and Anti Social Activities (Prevention) Act, 1986 at P.s. Nanpara, District Bahraich. It has been submitted by the learned counsel for the petitioner that the FIR has been lodged after two years of filing of charge sheet in Case Crime No. 109 of 2021 under Sections 60/63 of Excise Act and Section 272 IPC in which the petitioner has been falsely implicated and has been wrongly considered as gangster. It has further been submitted that the petitioner having been built up in the base case and is now being tried to put back in the jail and lodging the FIR. This Court has seen the FIR as well as gangchart and finds no good ground to show interference in the impugned FIR. Accordingly, the writ petition is dismissed.
