¶1One of the counsel for the petitioner has sent an adjournment slip.

¶2As the matter is very old, I do not intend to pass over the matter. Even otherwise, the petitioner has been filed against the refusal of injunction order and dismissal of appeal as grant of injunction in respect of recovery is specifically barred under order 39 as amended in the State of U.P. I do not see any reason to keep the matter pending.

¶4The petitioner, however, would be at liberty to take such steps to protect his rights as may be advised in accordance with law.
