Heard learned counsel for the parties and gone through the record. Petitioners have approached this Court for a direction in the nature of mandamus commanding the respondents to stop illegal construction of passage by respondent no.6 in the Bhumidhari land of petitioners bearing Khata No.204, Gata No.297 area 0.2770 hectare situated at Village Panchayat Bhatauta Tusli Patti, Pargana Aldemau, Tehsil Kadipur, District Sultanpur. In view thereof, present writ petition is disposed of, permitting the petitioners to move an application under Section 24 of U.P. Revenue Code, 2006 before the competent authority. In case such an application is moved by petitioners within a period of two weeks from today, the Sub Divisional Magistrate concerned shall proceed and decide the same by a reasoned and speaking order in accordance with law after hearing all parties concerned within a period of six weeks from the date such an application along with a certified copy of this order is moved before him. He shall also ensure that the matter is taken to its logical conclusion in accordance with law by fixing pillar/demarcation marks. (Manish Kumar, J.) (Vivek Chaudhary, J.)
