¶1Heard learned counsel for the petitioner, learned Standing Counsel for respondent no.1, and Sri Tusar Bhushan holding brief of Sri Shishir Jain, learned counsel appearing for respondents no.2 and 3.

¶2There is consensus at the bar that the matter in issue is squarely covered by the judgment of this Court passed in Writ-A No.7489 of 2023 in re: Ishaq Ali vs. State of U.P. and another, decided on 11.10.2023.

¶3Accordingly taking into consideration the aforesaid consensus, the present petition is allowed. The order impugned dated 08.09.2022, a copy of which is Annexure-2 to the writ petition, is set aside. The matter is remitted to respondent no.3 to pass a fresh order in accordance with law and the relevant rules within a period of six weeks from the date of receipt of a certified copy of this order.
