Heard learned counsel for the petitioner, Shri Dev Rishi Kumar, learned counsel for respondents no. 1 & 2 and Shri Subham Tripathi, learned counsel for the respondents no. 3 to 7 With the consent of learned counsel appearing for the contesting parties, the writ petition is being finally decided. Though the prayer as made by the petitioner has been made in a very ambiguous manner yet learned counsel for the petitioner states that the salary for the period 01.07.2020 to 20.06.2022 while the petitioner was working on the post of Data Operator has not been paid to him till date. This Court had required learned counsel for Union of India to seek instructions in the matter. Today Shri Dev Rishi Kumar, learned counsel appearing for the respondents no. 1 & 2 states on the basis of instructions received through email from the respondent no. 1 that the amount sanctioned including the amount which is payable to the petitioner has been sent by the respondent no. 2 to the finance department for approval and as soon as the approval is received the payment of salary shall be made to the petitioner. The aforesaid statement is recorded. Considering that the respondent no. 2 has already proceeded with the matter pertaining to grant of salary to the petitioner and the approval of the finance department has been sought, the instant writ petition is disposed of with a direction to the competent authority to make the balance payment of salary due to the petitioner in accordance with law after the approval is received from the finance department and the amount be paid provided there is no legal impediment within a period of six weeks from the date of receipt of a certified copy of this order.
